WHEREAS, David W. Burnett and wife, Patricia J. Burnett by Deed of Trust (the "Deed of Trust") dated September 18, 2013, of record in Record Book 6, page 187, Register's Office for Grundy County, Tennessee, conveyed to David W. Marttala, Trustee, the hereinafter described real property to secure the payment of a certain Promissory Note, (the "Note") described in the Deed of Trust, which Note was payable to First National Bank; and,

WHEREAS, default has been made in the payment of the Note; and

WHEREAS, the owners and holders of the Note have demanded that the hereinafter described real property be advertised and sold in satisfaction of indebtedness and costs of foreclosure and sale in accordance with the terms and provisions of the Note and Deed of Trust.

NOW, THEREFORE, notice is hereby given that I, Jason N. King, Substitute Trustee, pursuant to the power, duty, and authority vested in and conferred upon me, by the Deed of Trust of record in Record Book 6, page 187, and Appointment of Substitute Trustee of record in Record Book 1099, page 643, both of the Register's Office for Grundy County, Tennessee, having been requested to do so by the lawful holder and owner of said debt, will on December 28, 2018, at 11:00 a.m. at the front door of the Grundy County Courthouse, Altamont, Tennessee, offer for sale to the highest bidder for cash, and free from all legal, equitable and statutory rights of redemption, exemptions of homestead, rights by virtue of marriage, and all other exemptions of every kind, all of which have been waived in the Deed of Trust, certain real property located in Grundy County, Tennessee, described as follows:

SITUATED IN Grundy County, Tennessee, and described more particularly as follows:

Beginning on the southeast corner at Paul Burnett and running North 82 deg. West 210 feet to the east line of Horton Hobbs; thence South 2 deg. West 215 feet with Hobbs line to a metal stake; thence South 82 deg. East 195 feet to a metal stake on the west side of Fire Tower Road; thence with the right of way of the said road North 8 deg. East 218 feet to the beginning corner, and the said lot containing 1.0 acres and is a part of the land of the grantor, reference R.O.G.C., TN in Deed Book 55, page 201, to which reference is hereby made. And the said land is bounded on the north by Burnett; west by Hobbs, bounded on the east by Towner Road and on the south by Mildred Cordell.

Being the same property conveyed to David W. Burnett by Warranty Deed filed for record on April 12, 2002 in Book 144, page 34, of the Register's Office of Grundy County, Tennessee.

Borrower also sells, transfers and conveys unto Trustee the following property affixed to the land:

2004 Cavalier 606 HS mobile home, vehicle identification number CV04AL0453490AB.

Together with all improvements, tenements, hereditaments and appurtenances, all easements serving or benefiting the property, and any or all fixtures or improvements attached to the property.

This sale is subject to any unpaid taxes, if any, any prior liens or encumbrances, leases, easements and all other matters of record including but not limited to the priority of any fixture filing. The property is being sold as is where is without warranty as to its condition and subject to all mortgages, liens, claims, rights and any and all unpaid taxes of whatever nature that may be liens against it. If the U.S. Department of the Treasury/Internal Revenue Service, the State of Tennessee Department of Labor and Workforce Development are listed as interested parties in the advertisement, then the notice of this foreclosure is being given to them, and the sale will be subject to the applicable governmental entities right to redeem the property, all as required by 26 U.S.C 7425(d)(1) and T.C.A. 67-1-1433(c)(1) or other applicable law.
