Attorneys from both sides got testimony from a potential trial witness.

Meanwhile, the hearing to argue a motion for dismissal has been moved to next week.

A video showed the altercation that led to the death of Gershun Freeman.

He was an inmate in 201 Poplar when it happened in the fall of 2022.

Courtney Parham and Stevon Jones were first indicted for second-degree murder a year later.

Seven other jailers were also indicted in connection to Freeman’s death.

FOX13 told you last month an attorney for Jones filed a motion to have the indictment dismissed due to prosecutorial misconduct and also asked to unseal the grand jury proceedings.

Prosecution of the case is being handled by Glenn Funk, the district attorney in Nashville, after the DA here recused his office to avoid a conflict of interest because of the relationship between the DA’s office and the sheriff’s office.

Defense attorneys allege that Funk’s team switched expert witnesses to get this indictment.

That’s why they want the indictment tossed.

Depositions and the motion hearing are now scheduled for next Monday.

This case is currently set to go to trial starting May 4th.
